Modifying its previous order, the court on Wednesday said: “The country authorities have filed a complete affidavit and also positioned an annexure on report viz. Uttarakhand River Rafting/Kayaking Rules, 2014. White river rafting is allowed inside the state, strictly consistent with the Uttarakhand River Rafting/Kayaking Rules, 2014.” The HC additionally authorized the navy to undertake white river rafting after taking all precautions and directed the national government to obtain essential no-objection certificates for the army within three days.
An application submitted in the HC discussed how “military personnel must undertake rafting as in step with their fashionable technique” in the nation’s rivers. A department bench of Chief Justice Rajiv Sharma and Justice Lok Pal Singh gave these guidelines even as listening to public hobby litigation (PIL) filed using Rishikesh-based social activist Hari Om Kashyap.
In his PIL, the petitioner pointed out that the government was issuing unlawful leases in favor of non-public agencies within the riverbed of the Ganga. According to the PIL, brief structures had been allowed to be installed at the banks of the Ganga, and rafting was being carried out using personal marketers without following any law.
